One of the most common questions that I get during a free initial consultation is how long will my bankruptcy remain on my credit report. The answer depends on the type of bankruptcy that you file.
Chapter 7 Bankruptcy
If you filed a Chapter 7 bankruptcy then your bankruptcy will appear on your credit report for a period of ten (10) years from the date that you filed.
Chapter 13 Bankruptcy
If you filed a Chapter 13 bankruptcy then your bankruptcy will appear on your credit report for a period of seven (7) years from the date that you filed.
What if I dismissed my Case or didn’t go through with it
Sometimes debtors will file a bankruptcy, in bad faith, to stop a foreclosure sale, and then not follow through and the case gets dismissed. If your case is dismissed it won’t make a difference the bankruptcy filing appearing on your credit report. It will still appear and be subject to the same timelines above.
